Parashat Shoftim is the 48th weekly Torah portion in the annual Jewish cycle of Torah reading.

Torah Portion: Deuteronomy 16:18-21:9

Shoftim (“Judges”) discusses guidelines of leadership, opening with a command to appoint judges and continuing to detail laws of kings, priests, and prophets. It also describes laws relating to cities of refuge for accidental killers, false witnesses, warfare, and the rite performed in a case of unsolved murder. [1]

What would a society be without a system of courts and police?  But not just any system of justice; we’re Israel and we have to do it right. And consider that we have to set an example for everyone else. Not only that, but when there is a king in Israel, he has to write for himself two Torahs and study it every day so he knows the laws and commandments!


Consider the conditions that are being set.  No one is to get any favoritism.  Both parties either sit or stand, for example, something even as benign as that.


In capital cases, there needs to be at least two witnesses who saw the person get warned and then go ahead and do it.  Three is better, but no conviction with only one. And if two witnesses testify, and then two other witnesses testify that they saw them in a different place so they couldn’t possibly have seen the act be done, then the first two witnesses are disputed and the suffer the punishment that would have befallen the accused.


So the conditions are tough.  And they start out with the admonition: “Justice, justice, shall you pursue”. In ancient Hebrew, doubling a word like that increases the importance of the command.  We should endeavor to carry that out even today.

Shoftim («Jueces») aborda las pautas de liderazgo; comienza con el mandato de nombrar jueces y continúa detallando las leyes relativas a reyes, sacerdotes y profetas. También describe leyes sobre las ciudades de refugio para quienes causaron una muerte accidental, los falsos testigos, la guerra y el rito que se realiza en caso de un asesinato sin resolver. [1]

¿Qué sería de una sociedad sin un sistema de tribunales y policía? Pero no se trata de cualquier sistema de justicia; somos Israel y debemos hacerlo bien. Además, debemos tener en cuenta que hemos de dar ejemplo a los demás. No solo eso, sino que cuando hay un rey en Israel, ¡debe escribir para sí mismo dos copias de la Torá y estudiarlas todos los días para conocer las leyes y los mandamientos!


Consideremos las condiciones establecidas. Nadie recibe trato de favor. Ambas partes deben estar sentadas o ambas de pie, por ejemplo; se trata de detalles incluso tan sencillos como ese.


En los casos que conllevan la pena capital, se requieren al menos dos testigos que hayan visto cómo se advertía a la persona y cómo esta, a pesar de ello, procedía a cometer el acto. Es preferible contar con tres, pero no puede haber condena con uno solo. Y si dos testigos declaran, pero luego otros dos afirman haberlos visto en un lugar distinto —de modo que habría sido imposible que presenciaran el hecho—, entonces el testimonio de los primeros queda invalidado y ellos mismos sufren el castigo que habría recaído sobre el acusado.


Así pues, las condiciones son rigurosas. Y todo comienza con la exhortación: «Justicia, justicia perseguirás». En hebreo antiguo, la duplicación de una palabra de este modo realza la importancia del mandato. Deberíamos esforzarnos por cumplirlo incluso hoy en día.
